These terms are the agreement between you and Apex NFT Card Services, LLC ("Apex", "we", "us"), 5 Brayford Square, London E1 0SG, United Kingdom, for the Apex VCards website, memberships, member web pages and laser-etched aluminum cards. By creating an account or placing an order you agree to them.
1. The service
An Apex VCards membership includes a live digital business card and one-page member website hosted on apexvcards.com, editing tools (the Design Lab and Page Builder), and the aluminum card(s) included in your plan, laser-etched with your approved design and programmed with an NFC chip and QR code that open your page.
2. Accounts
You must be at least 18 and give accurate details. You are responsible for keeping your password safe and for everything done through your account. Tell us right away at sales@apexvcards.com if you think your account has been used without permission.
3. Plans, billing and renewal
- Memberships are billed yearly in advance. Prices are shown on the pricing page at the time you order and include the cards listed in your plan.
- Your membership renews each year at the then-current price unless you cancel before the renewal date. We will remind you before renewal.
- Extra and replacement cards are a one-time charge, shown in your dashboard before you pay.
- Prices exclude any sales tax or VAT that applies where you live, which is added at checkout.
- Refunds and cancellations are covered by our Refund & Cancellation Policy, and returns and replacements by our Returns & Card Replacement Policy. Both form part of these terms.
4. Your design and approval
You design your card yourself in the Design Lab (or ask us to set it up for you) and approve a final proof before anything is etched. Please check the proof carefully: spelling, phone numbers, emails, web addresses, colors and the position of your logo. Once you approve a proof, the card is made to order exactly as shown, and mistakes in an approved proof are not our responsibility. Laser etching is one color on anodized aluminum; small variations in finish and shade between batches are normal and are not defects.
5. Your content
- You keep ownership of the logos, photos, text and other content you upload. You give us a license to store, display, reproduce and etch it only as needed to provide the service to you.
- You confirm you have the right to use everything you upload, including trademarks, logos and photos of other people.
- You must not upload or link to anything unlawful, misleading, hateful, sexually explicit, infringing, or that impersonates another person or business, or use your page for spam, phishing or malware.
- We may refuse to etch a design, or remove or disable content or a page, that breaks these rules. If a complaint is made about your content we may contact you and may take the content down while we look into it.
6. Our property
The Apex VCards site, software, templates, the Apex name and logos, the card shape and the Apex contactless mark belong to Apex or our licensors. Premium page templates are licensed to you for use on your Apex member page only while your membership is active.
7. If your membership ends
If you do not renew, you have a 30-day grace period. After that your page shows your name and an inactive notice until you renew; when you renew, your existing card, QR code and chip work again right away. We may delete page content 24 months after a membership ends (see our Privacy Policy). We may suspend or close accounts that break these terms, misuse the service or do not pay.
8. Availability
We work to keep apexvcards.com available at all times, but we cannot promise it will never be interrupted, for example during maintenance or problems outside our control. NFC behaviour depends on the phone used: some phones need NFC switched on, and the QR code always works as a backup.
9. Liability
To the extent the law allows, the service is provided "as is", and our total liability to you for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses such as lost profits, lost business or lost data. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
10. Changes
We may update these terms. We will post the new version here with a new effective date and give members notice of important changes. If you keep using the service after a change takes effect, the new terms apply; if you do not agree, you can cancel as described in our Refund & Cancellation Policy.
11. Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, and disputes will be handled by the courts there. If you are a consumer living in the UK or EU, you also keep the protection of the mandatory laws of your country and may bring a claim in your local courts.
